1. Acceptance of Terms

By downloading, installing, or using the TravelHawk mobile application (“the App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the App. We may amend these Terms at any time by posting the amended terms in the App. Your continued use of the App after such posting will constitute your acceptance of the amended terms.

2. Description of Service

TravelHawk provides users with real-time, location-based crime statistics and safety alerts. The information provided is aggregated from various public and private sources and is intended for informational purposes only. While we strive for accuracy, we do not guarantee the completeness, timeliness, or reliability of any information provided through the App.

3. User Conduct

You agree to use the App only for lawful purposes. You are solely responsible for your use of the App and any consequences thereof. You must not use the App to harass, abuse, stalk, threaten, or otherwise violate the legal rights of others.

4. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis. We expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the App will meet your requirements, be uninterrupted, timely, secure, or error-free.

5. Limitation of Liability

You expressly understand and agree that Skeep Technologies (Pty) Ltd shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use or the inability to use the App. The information provided by TravelHawk is not a substitute for official law enforcement reports or personal vigilance.

6. Intellectual Property

All rights, title, and interest in and to the App (excluding user-provided content) are and will remain the exclusive property of Skeep Technologies (Pty) Ltd and its licensors. The App is protected by copyright, trademark, and other laws of both South Africa and foreign countries.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions.

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. You agree to submit to the exclusive jurisdiction of the courts located in Johannesburg, South Africa, to resolve any legal matter arising from these Terms.
